Terms of Service

1. Acceptance of terms

Giftnovo is operated by GiftcardNOVA SA, registered in Belgium (Rue Royale 4, Spa 4900, Belgium).

By creating an account or using Giftnovo (the "Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. The Service is not available where prohibited by applicable law.

3. Description of the Service

Giftnovo is a P2P marketplace: gift card buying offers are published by other verified users, backed by their own balance on the platform. Each trade is reviewed manually through a chat before any payout is released.

4. Account registration

You must provide accurate information and keep your password secure. You are responsible for all activity that happens under your account.

5. Identity verification (KYC)

We may require identity verification before allowing certain actions, such as withdrawals above a set threshold. We may reject, delay, or reverse a transaction if verification fails or the information provided is false.

6. Selling gift cards

When you open a trade, you agree to provide accurate gift card details through the trade chat. Payment is released to your wallet only after the gift card is confirmed valid. Giftnovo may cancel a trade if the gift card cannot be verified, appears fraudulent, or the code does not work.

7. Buying gift cards

When you buy a gift card, the price is deducted from your balance as soon as you confirm the purchase. The purchase is subject to actual code availability: if for any reason we can't source it after your purchase is confirmed, we refund the amount to your balance.

8. Delivery of gift card codes

The actual gift card code is delivered by email after your purchase is confirmed. Delivery is manual, not automatic, and can take longer during periods of high demand. It's your responsibility to confirm the gift card's region or currency matches the account or merchant where you plan to redeem it before you buy.

9. Refunds and invalid codes

If the code you received doesn't work or was already used, contact us within 48 hours of the purchase with as much detail as possible. We review each case: if we confirm the issue, we refund the amount to your balance or provide a replacement code, subject to availability. After that window, or if the code was successfully redeemed, a refund isn't guaranteed.

10. Prohibited uses

You may not use the Service to submit stolen, fraudulent, or unauthorized gift cards; to launder money; to violate any applicable law; or to interfere with the operation of the Service.

11. Wallet, deposits, and currency conversion

Balances shown in your wallet are internal ledger entries and do not represent individual on-chain custody of cryptocurrency: funds are managed by Giftnovo, and withdrawal requests are reviewed and processed manually by our team. Deposits are credited to your balance once payment is confirmed through our crypto payment processor. Your wallet operates in one currency at a time; you can convert your balance to another supported currency, seeing the exchange rate before confirming.

12. Referral credits

If you invite someone with your referral link, both you and the person you invited receive a bonus in your balance once that person completes their first trade or purchase. The bonus is paid once per referred account, and the amount may change without prior notice.

13. Disputes

If there's a disagreement about a trade or a purchase, you can open a dispute from the relevant chat. Our team reviews the case, including chat messages and any available evidence, and decides whether the payment is released, cancelled, or refunded. That decision is final within the platform.

14. Fees and rates

Exchange rates are shown on each offer before you open a trade and may change between offers. Giftnovo does not guarantee that any particular rate will remain available.

15. Disclaimers

The Service is provided "as is" without warranties of any kind. Cryptocurrency values are volatile, and Giftnovo is not responsible for market fluctuations.

16. Limitation of liability

To the maximum extent permitted by law, Giftnovo is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

17. Account suspension and termination

We may suspend or terminate your account if we reasonably believe you have violated these Terms. While we investigate a possible violation, we may pause trades, purchases, or withdrawals on your account. If your account is suspended, any pending balance is resolved on a case-by-case basis, prioritizing returning what's owed once the investigation is resolved.

18. Changes to these Terms

We may update these Terms from time to time. Continuing to use the Service after changes take effect means you accept the updated Terms.

20. Governing law

These Terms are governed by the laws of Belgium, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service is subject to the exclusive jurisdiction of the courts of Belgium.
